QUESTION

Is he legally allowed to kick us out this since we are technically and legally still married?

Asked on Mar 03rd, 2015 on Divorce - California
More details to this question:
I am a stay at home mother going through a divorce. My husband told me he is not going to be paying for my rent or expense anymore and closed down my credit card we used to share. I am trying to find a job that works with the hours that my daughter is in school. My husband just told me that if I don’t pay the rent in the next few days, I will be evicted by the landlord. My daughter and I will have no place to go.

You misrepresented this scenario. "My husband just told me that if I don't pay the rent in the next few days, I will be evicted *by the landlord*."

You have a right to request both child support and spousal support payable by your husband from the Court. You should consult with a lawyer or talk to the self help center at your local courthouse. You can stay in the residence until the eviction process is complete. You can talk to your landlord about renting the apartment after you get your support.
