Yes, you can get a default entered if they do not respond after 20 day period.

You need to ask the clerk to enter a default against your spouse and then schedule a final hearing with the judge so you can get the Final Judgment entered.

Yes it is a divorce whether the other party returns documents or not. The 20 day time frame only applies when a party has been legally served papers by either the sheriff or a private process server. A response to the papers must be filed within 20 days. We don't know the facts of your case and it would not hurt to call around to attorneys in your area seeking a free consultation.
