QUESTION

Is my marriage void if my ex’s divorce wasn’t final yet when we got married?

Asked on Oct 21st, 2014 on Divorce - Colorado
More details to this question:
I married my husband in 2006, thinking that his divorce in another state was final. It was not final for another 2 years, and we broke up soon after that. I always considered the marriage as void because I was single and eligible to marry and he wasn't. I now wish to remarry and not sure what I need to do. My ex and I had 2 children during our time together and I do not wish to pursue child support or have a court try to determine custody, as he already pays it to me and also splits time with the kids.

You probably should file for invalidity of marriage to ensure your planned marriage is valid without question. You could get a copy of his prior divorce decree as evidence that your 2006 marriage was not valid.
