My spouse and I were recently divorced after 28 years of marriage with a simple no-contest divorce. I have been retired for 3 years and she is still a working professional. I only have social security and a small state pension of approximately $400. I know we are both liable for delinquent taxes. She agreed to pay the delinquent taxes and started those payments. Now, she says she is submitting a form to the IRS to have the monthly payment she has been making paid equally by each of us. I do not even have enough to live on. I currently reside with our youngest daughter?
Assuming the divorce judgment stated she will make all payments, you will have to file a motion for contempt with the Court to enforce the judgment. If the judgment did NOT mention that issue, you will either have to pay your share or Petition the Court for a modification to require her to keep paying. Good luck.
