QUESTION

Looking for a divorce, UK and US citizens.

Asked on Jun 11th, 2014 on Divorce - New York
More details to this question:
My "wife" and I were married back in 2000 in the state of NY.We seperated in 2003 and I returned to the UK in 2004. She's taken steps, since then, to prevent any contact with her or the children but has made various attempts to collect child support. I would like a divorce so I can marry my current partner. She had me forcibly removed by the police when we seperated (claiming I was mentally ill (I was on antidepressants at the time)). Can I file in the UK (I don't care if NY recognises the divorce, as long as UK law does) so I can marry again?

Yes, if you qualify under the law of the UK you can get a divorce there. Just make sure you properly serve the legal papers commencing the action on your spouse. Alternatively you can seek a divorce in New York if she is a resident here.
