That's not grounds for an annulment - it's grounds for a divorce.

If you are a resident of New York, it is best for you to file here in your home state.  If your spouse is in agreement, an uncontested annulment can be completed relatively quickly and without the need for a court appearance in New York.  It will not be a problem that your spouse is leaving for Europe--the paperwork can be drafted and filed the same day and she can sign immediately thereafter, before she leaves.  Feel free to call me for a free consult--I will be at my desk until 5:30pm today.
