I do not want to go back to that state, but if he files for divorce, will ihave to move back? Or should I just avoid being served. HELP! Your husband cannot make you move back into the home with him.  If a divorce has been filed, then you are not permitted to move a child to a different state without a court order.  If you moved prior to the divorce being filed, and if he files a motion requiring that the child be returned to the state, then the Court will have to decide whether to grant that motion.
