QUESTION

My husband left in 1982. Are we considered divorce?

Asked on Jul 10th, 2013 on Divorce - Michigan
More details to this question:
My husband moved out May 1982. I never filed for a divorce because I had no money. He's had several places of residence, currently in Nevada which I had no idea until recently. My son's 35 and his father quit all contact when he was 12. He still owes me a great deal of money. Would we be considered divorced?

No, you can only be divorced by an order from a Judge. You should consult with an experienced family law attorney to discuss your rights. In Maricopa County, and other counties in Arizona, there is a self service center at the courts, or online, that provides the forms and instructions.

No, the passage of time alone is insufficient to grant you a dissolution. You should consult a family law attorney or facilitator about the procedures.

Unless one of you has filed for and obtained a divorce decree from a court of competent jurisdiction, you are still married.

No you are still married.. it takes a court judgment to get divorced..Further you can probably kiss the money he owes you goodbye.. its long past any statute of limitations (in the absence of special circumstances like tolling).

You are not divorced until a court entered a Judgment of Divorce. If you have never filed, you will have to file and go through the process.
