You will need to consider filing for divorce. A preliminary injunction is put into place when you file a petition for dissolution, which prevents the sale of community property unless by consent of the other spouse or by court order. Move your money into a separate account. Put your paycheck into the separate account. Then file for divorce. Idaho states that community property should be divided 50/50, generally, so start making a list of the property.

You need to close all joint bank and credit card accounts. After filing for dissolution, request an order of the court for the temporary use of any joint assets that you have such a the house and your car.

Start divorce proceedings and have him personally served with the paperwork. In California, as soon as he is served the paperwork from the court, you both are forbidden from buying, selling, encumbering any assets of the marriage. An attorney will be able to help you proceed from there with Discovery and moving forward to a fair settlement.
