QUESTION

New York state law regarding bigamy

Asked on Sep 17th, 2013 on Divorce - New York
More details to this question:
I live in upstate NY and have been married since 10/18/2000. I discovered a while back that my wife married another man about two years later, circa DEC 2012 in Las Vegas. I found their wedding license number on line at the Clark County Recorder web site. What are my rights? Can I get my marriage annulled and can I walk away from this clean without paying alimony.

No, you can't void your marriage because of something that may or may not have happened 12 years later. The real question is whether you ever were divorced... which you may have been if she remarried.

It appears from the information provided that your wife married another man AFTER you and your wife were married, before being divorced from your wife.   This allows your wife and the second husband to annul that marriage based on bigamy, but it does not annul your marriage if she was not legally married at the time you married your wife.
