QUESTION

No Verified Complaint but received an RJI notice from my husband

Asked on Aug 28th, 2014 on Divorce - New York
More details to this question:
I and my husband have been in a difficult divorce. I have breast cancer and he is now trying divorce me quickly. I have been served with a Notice of Summons and sent in a Notice of Appearance and Demand for Complaint. The Notice of Summons was dated 2/12/2013, but my husband just served them to me pro se on 7/10/2014. I have not received a Verified Complaint, but have received his petition for an RJI. I served him the papers and filed the Affidavit of service over 25 days ago and now I am just receiving the RJI. I am pro se as I don't have any money to fight him. He has an attorney. What would be the next steps since he has not served me with a Verified Complaint?

If you sent a Notice of Appearance and Demand for Complaint you made a tactical error - something that often happens with people who try to save money by not hiring an attorney. If you had not responded in that way the Summons with Notice would have been void because it was too late. If he has an attorney you should get one - and if he has all the money he may be required to pay for yours.
