More details to this question:
My husband and I have been married for almost 3 yrs and for most of our marriage live in his country. As soon as I came to the Virginia USA I went to visit my family and my husband told me not come back home and leaving bad text messages about m e and my child. I know I could fill for "de facto" divorce but that is a one year wait in the State of NY and I want a divorce ASAP. He was abusive . what is the best grounds of divorce that would also show how of an unfit parent he is being that he abandoned his finanical responsiblities. Also if there is a way around this one year wait, please tell me

There is no requirement in Nw York of a one year delay.  As to the other issues you should discuss your situation in detail with a local divorce lawyer.
