QUESTION

Pension with ex wife

Asked on Dec 08th, 2014 on Divorce - New York
More details to this question:
My husband recently retired. He has been separated from his ex wife for over 20 years and divorced for 7. Her cousin (lawyer) actually did the separation papers. During the divorce, no separation papers were to be found recorded. Does he have to pay his ex wife half of his pension like he has been doing ? What can we do about finding the separation agreement ? Also is the cousin (lawyer) at fault here? This was a legal separation in front of a judge. Went to City Hall and no such papers were ever filed. Is there any way to get an amendment so she does not get 1/2 anymore ?

Divorce papers aren't filed at City Hall. They're filed with the court clerk. If it was done in front of a judge there is a transcript. Consult a local lawyer when you have those documents.
