QUESTION

Should I pay out my ex fiance when I refinance?

Asked on Jan 15th, 2013 on Divorce - New Jersey
More details to this question:
My fiance and I own a home together, we purchased the home in April 2012, so we've been living together for roughly 9 months. She's been cheating on me and we have decided to go our separate ways. I believe she's willing to let me refinance the home into my name and sign off on the old loan and the quit claim deed form and will not been seeking any money from the home, even if it has gone up in value. Should I give her half of the new appraisal value after I refinance? Basically I don't want to run into trouble years down the road and her be able to sue or look for money out of the house if I sell it eventually.?

If you buy her out, at whatever price, and she signs off on the deed and the mortgage, she cannot come back to you later and look for more money.  You were not married, and do not have to get divorced, therefore you can make what ever deal you want, and she cannot challenge that later.
