QUESTION

Should I sign the title over before the judge orders me?

Asked on May 21st, 2013 on Divorce - California
More details to this question:
I live 200 miles away from where my divorce is taken place. The court and his lawyer agreed I could do it over phone then they sent me letter saying I had to sign title of car when my soon to be ex comes down here and if I don’t they won’t agree to me just doing the final hearing over the phone I have no way up there and he has both vehicles.

File a copy of that letter with your request to make the next phone appearance. I have a feeling the Judge won't like that kind of tactic being used to get you to sign over title of a community asset that the JUDGE has not yet ruled who should get it, or if it should be sold (even if he/she said he/she was inclined to rule a certain way). Unless you are getting something in exchange that you feel is fair and both things are included in the writing, you should not be transferring assets that have not been as ordered by the Judge.
