QUESTION

What am I entitled for if I file a divorce?

Asked on Oct 15th, 2013 on Divorce - Michigan
More details to this question:
I have been married with my husband for almost 4 years and we have a child. However I found out he cheated on me, and he break the promise of not talking to some women. I don't have a job because our daughter is not in school yet. I need to find out what will I get other than child support. Am I entitled of alimony? What about the car I have? It is on his name, and mine it is just on the insurance policy. He is a military member.

You will be entitled to one half of the property accumulated during your marriage and temporary spousal support in addition to child support. His actions are irrelevant to how the property will be divided or what support will be ordered.

Because he's in the military, there may be some limitation on you seeking a divorce, unless he agrees to allow you to proceed. You're entitled to child support based on his income. If you can show special need, you will get spousal support for a limited time. Special need may include time to re-train yourself for a job.

You could get alimony for a short time, but will have to start looking for work. Your daughter can be in day care. All assets, the car, furniture etc. are divided in a divorce. If you have customarily used the car, you can ask for it and he can have some other asset instead. Since he is in the military, his need for the car is likely minimal. Your child support can come directly from his military pay.

Buy an hour with an attorney to explain the circumstances and details, gaining some reliable advice. I do not have enough details to advise further.
