What are my options in obtaining the house?

More details to this question:
Ex wife wants to transfer deed over to me. House has been vacant for 2 years. And behind on payments. Bank has not foreclosed yet. Ex- wife still owns house. In divorce, I agreed to a short sale. What are my options in obtaining the house? If any?

Your ex-wife can certainly quit claim her interest in the home to you. Whether or not that is a good idea depends on many factors, including whether or not there is equity in the property and how large the delinquency is . Your ex-wife quit claiming the home to you will not release her from liability on the mortgage.

Since you would be modifying your Judgment, you should consult a family law attorney to review the Judgment and advise you.

I do not have all of the facts, however if she quit claim to you are interested in the property it will be subject to all of the liabilities remaining due on the property. I would see an attorney and look at this particular gift horse in the mouth.

The ex - wife can sign a deed conveying ownership to you. I suggest you hire a lawyer.
