What are my rights in divorce settlement?

My husband abuses me mentally, sexually and he keeps threatening me that he is leaving because he is fed up with me because I can't do everything he wants.

In a case like this, you really should consult an experienced divorce lawyer. You may have various claims against your husband which are not apparent to a lay person. As to your entitlement to property division, the presumption is a 50/50 division, but the court may vary from that in accordance with 10 or 11 'equitable considerations.' Similarly, you might or might not be entitled to maintenance (i.e. alimony). Every case is different from every other. Hire a good lawyer.

Immediately go to court and file a retraining order ask for him to be kicked out of the house and file for divorce. If you wait in Filing for divorce he can move money so so both at the same time. Next time he hits you call the cops and make sure to Agree to press charges.
