What are the procedures for uncontested divorce?

Wife and I are separated and have agreed on all details, including our 7 yr old son. Needs to know steps and cost of divorce.

The Court charges a filing fee of about $185.50 (this number may have increased just a bit). If you want to do this by filing forms, you can get printed forms from the Clerk of Courts in your county. But...when important interests are at stake, it's usually best to hire an experienced lawyer. Good Luck.

Find an attorney mediator to do all the paperwork. Should cost you between $2,500 and $3,500. Then you'll have to pay the filing fee - check with your local court.

You need to have a lawyer prepare all the paperwork to submit to the court to get a final judgment of dissolution. Costs range from $1500 and up.

The steps/cost depend on whether you are wanting to file the paperwork yourself or whether you are wanting to have a lawyer draft the documents for you. I won't speak for what other attorneys might charge; however, whether you are represented or not, the court will charge filing fees (in Maricopa County) of $321 for the Petitioner and $256 for the Respondent. I recommend you consult with an attorney to discuss this matter in greater detail.

An "uncontested" divorce is no different from any other divorce except that at the end of the process a judge approves everything you and your wife have agreed upon instead of making the decisions about things you don't agree on.

One of you should get to an attorney, who has it all set up to do uncontested divorces. A petition, answer and waiver, agreement, motion for judgment on the pleadings, and a final judgment have to be prepared. The filing fee is $400. You can go to flcourts.org and try to do it yourself with forms that you can find there. But it is best to actually hire an attorney.

File a complaint, have your spouse accept service and file a stipulated judgment of divorce. However, despite your best efforts, you will not be granted a divorce until each of you have attended the Focus on the Child Class. Less than $300 without an attorney, more if you hire an attorney.

An uncontested divorce costs about $2,000. You cannot have the same attorney represent your both. You can do it yourself using the State Supreme Court's web site, but that can be very time consuming.
