QUESTION

What can I do if my wife married me under false pretense?

Asked on Jun 19th, 2014 on Divorce - Florida
More details to this question:
I found out 9 months into my marriage that my wife married me for citizenship and to get benefits from my veteranโ€™s disability. She obtained the ability to get the veterans to pay for her doctor of philosophy degree. She is in fact a genius and specializes in Math. I moved out and she filed for an apportionment, which means she gets part of my veteran disability check. Is that legal? I had a lawyer but he died before a divorce could be finalized.

You don't say how long you have been married, but if you found out about her fraud 9 months into the marriage, you may have been able to seek an annulment rather than a divorce. You need to hire another attorney to look into your rights and options, and act accordingly on your behalf.

You can get the divorce and report her to immigration authorities or try for an annulment based on fraud and report her to immigration authorities. Use of a lawyer is recommended.
