QUESTION

What can I do to get a final judgement in my divorce?

Asked on Nov 15th, 2012 on Divorce - Florida
More details to this question:
The lawyer handling my divorce has said we are waiting for the final judgement since August. Every time I ask him why it's taking so long he says it will be done that week. Then another week passes and another and another. Now we are almost to Thanksgiving and no final divorce. I was only married to my husband for 8 months, no kids, no property, no nothing. How can I get a swift resolution? I don't know what to do. I MUST be divorced soon so I'm not screwed out on my taxes for another year!

You need to talk to your attorney on this one. He's the one who's doing the judgment. If necessary, get rid of him and hire someone else to finish things up. However, hiring another attorney may not be any faster as they'd have to get up to speed.

Check with the court clerk. There may be a backlog in the clerk's office otherwise go and talk to your lawyer.

My suggestion is that you file a 'formal' complaint against your attorney, with the State Bar Association and send a copy of the complaint to your attorney. My guess is that as soon as he receives a copy of the complaint, he will complete your case.

Someone has to write it up. You could ask your attorney to write it up if the other side won't, but it will cost money for your attorney to do it.
