QUESTION

What can we do if divorce is taking a year to be processed?

Asked on Jan 10th, 2014 on Divorce - California
More details to this question:
My boy friend filed a divorce on February of last year. His wife and child are not here in the US nor a US citizen though he makes sure that he is sending child support every month. The last we checked with the case summary filed at city hall downtown, it says judgement package received 2336. The person who processed works at the paralegal but it seems they don't follow up the processing because yesterday another paper came about child custody at my boy friend's house and they said they don't know what it is for because when they submit the paper, it states there that child and wife are not here in the US. It seems even the paralegal don't know what they have to do and why the divorce is taking this long.

Your boyfriend should hire an attorney to get it done quickly. Without having the file of what happened, it is impossible to know. Perhaps the court is just waiting for your boyfriend to submit the form order for the court to sign.

Divorces are filed with the court not city hall. If it was filed in King County, the trial date would be about a year after the petition was filed. I suggest your boyfriend get a lawyer since he obviously doesn't know what he's doing.

I believe that whatever papers need to be signed by the wife need to be acknowledged by the embassy office where she is located.

I don't know what county you are in but in Sacramento County the Court Clerks are about 800 to 1000 behind on processing of divorce judgments. It is taking from 2 to 4 months to get judgment documents back from the court even in uncontested cases. The court administration blames a lack of funding.
