QUESTION

What do I do about the back spousal support payments?

Asked on Aug 18th, 2012 on Divorce - California
More details to this question:
I divorced in CA in 2003, after 22 years of marriage. The Marriage Settlement Agreement indicates Spousal Support Payments if I was unemployed. I was unemployed from 2006 to 2011. Can I file payments for that time?

I would have to read the MSA. Why did you not ask for them when you were unemployed? I can't answer without the document. Off the top of my head, probably not.

It is going to depend upon the specific language of your agreement. Bring the agreement to a family law attorney for an opinion.

Great question. If your settlement agreement allows you to receive spousal support, then yes you can. Go ahead and file a claim for the time you were unemployed. Good luck.

Was there a specific amount? If not, then they are probably lost. You have to file a request and the court cannot generally order back support.
