QUESTION

What do I do if my divorce lawyer is incompetent?

Asked on Aug 01st, 2013 on Divorce - Michigan
More details to this question:
She did not return phone calls. I did all the financial preparation which she did not appear to look at after months of sending different versions, I was told she could not open the file. I was basically strong armed into taking a deal I was not comfortable with because she said they would not agree (and I used all of the numbers they came up with). I was told in the beginning, from my lawyer, the Judge did not like men and the field of work I was in, etc. The divorce is now final, the agreement and promissory note have been signed by both parties, notarized and filed with the court. They are now trying to change it and "my" lawyer is agreeing with them. What are your thoughts?

You can, and should, first hire a new attorney. Once the issues that are pending are resolved, you can decide whether or not you want to make a complaint to the bar association.

My thoughts are that you should consult with other attorneys and seek their advice. At the end of the day, you are the client so the attorney should not be forcing you into a corner, you are the final decision maker for your own case. I do not know the terms of your agreement so I can not advise on whether your judgment or agreement was reasonable.

It sounds as if you really need a second opinion and have grown distrustful of your counsel.
