What do I do now that I had to leave the state for help?

More details to this question:
Our papers state neither of us can move out of state. But recently I had no choice but to leave the state and I have notified my ex and his solution is to lie to the courts and I can't trust him.

The court order probably says you cannot leave the state without the permission of the court. File a motion with the court seeking permission to relocate out of state. If your ex does not oppose it, it should be granted.

The automatic temporary restraining orders that issue with the serving of the Petition states any children of the parties may not leave the state. If you left and you don't have children you are fine. You will need to make arrangements to appear at any hearings by telephone. If you left with a child and your spouse is in agreement that you could leave with the child you both should sign an agreement stating your agreement. If there is a hearing supply a copy of the agreement.

Notify him by certified mail of your move. He has a certain period of time to object in writing. If he doesn't, you are free to go.

Your best avenue of action is to notify the Court of why, how and when you had to move. Giving the Court goodreasonsfor the move will give you the best support for the move and will assist you in the modification of the Court's Order. I would also advise you to seek counsel to asssit you in this matter, since you fear he will lie to the Court's agaisnt you.

Did you take the child out of state with you? If you did he will probably get custody, and you will need an attorney.
