QUESTION

What do I do with if I forgot to check a box in the petition?

Asked on Jul 03rd, 2015 on Divorce - California
More details to this question:
I filed for my default but notice that I forgot to check a box on the petition. So the judge denied it. So what do I do about the box that I should have checked on the petition? Do I start over? Since I file the petition in February 2014 and the court says that I can’t file for custody or visitation.

File an amended petition. Since the other side has not appeared you can file it as a right without leave of court. Then, you will have to serve him with the amended petition and give him time to respond to the issues raised by that document (30 days).
