QUESTION

What do I have to do to get a divorce? How?

Asked on May 14th, 2015 on Divorce - Florida
More details to this question:
We have no children and no property or money involved when we got married. I was only with the woman for three months and have not lived with her since. She went to prison first then I went to prison and now I would like a divorce but really do not know how to go about it. Last time I talked to her she had no objection to the divorce. Tell you the truth I do not even remember the date we got married.

Your divorce would be very simple. Take a look at the self help forms available from the Nebraska Supreme Court.

If you are in IL and she is not objecting to the divorce, you have an uncontested divorce, which is fairly simple and relatively quick. Only minimum information is needed, including the date of marriage, however. Seek a divorce attorney for specific information, as we have additional questions, such as where is your wife presently?

If you are really that un-knowledgeable about divorce and court procedures you will need to hire an attorney to do it right.

In the case of a very short marriage to which the spouses are obviously not much committed, and if there are no children and no property, it can be quite simple. I suggest you find a lawyer: it's usually worth the investment. For a simple case, though, you can seek help. In some counties there are family law clinics held for a few hours each week in the county courthouse. Call the clerk of court in the county where you live to see if they have one, and when and where it meets. Good Luck.

The best way to proceed would be to hire an attorney to help you finalize a divorce. If you are both in agreement, the process should only take a couple months.

Engage an attorney, file in the appropriate jurisdiction and venue, agreed to the dissolution and it should be done in 60 days if you are in Michigan.

Have you considered Mediation? Mediation is Fast, Effective and Affordable. If she agrees, with what you have said, you could get it done with Mediation for a max amount of around $500 plus Court costs. Good luck.
