QUESTION

What happens if plaintiff does not make it to trial?

Asked on Mar 08th, 2013 on Divorce - New York
More details to this question:
I am the plaintiff in a divorce trial that will occur this April. I was currently diagnosed with depression, high blood pressure, and anxiety. I am currently on two medications. The trial was already postponed. If I do not make it, will they be able to continue without me? I really cannot take the stress. I will not be able to testify. Can this trial continue without my presence?

That depends upon the circumstances. It's possible that the case will be dismissed if you fail to appear.
