Hire an attorney and proceed with an uncontested divorce where both parties agree upon everything, such as child custody, visitation, support, equitable distribution and more and get it done. If the parties are both reasonable adults it should not take more than a month or two to finish everything up and submit it to the court. It is usually not as easy as people think when they start, but it can be if everyone wants to get it done and they both act reasonably towards each other.

The answer to your question is it depends on how cooperative the parties are in negotiating a settlement. However, regardless of the level of cooperation your status from married to single will not become effective until six months and 1 day from the date the court retains jurisdiction over the parties. Generally, this is the date the respondent (the person who did not file the petition) is served.

The fastest way to get divorced is to get the advice of a competent family lawyer as to what needs to be agreed upon. Sit down with the spouse and negotiate the resolution of each issue. Hire the attorney on an uncontested divorce basis.

If your spouse agrees the parties can do a joint summary petition, but not if kids, support requested, real estate or large propery or bills. Any divorce requires 6 months from service of the petition before you can be declared to be single again.
