What options do I have to file for divorce?

More details to this question:
I want to divorce my husband of 19 yrs but I can't afford to. I am a stay at home mom and have been for 15 years. My husband controls all the money, only giving me barely enough to pay the household bills and groceries. The rest he says he keeps in his personal business account which I do not have access to including our jointly filed tax returns. I am looking for work but have been unable to find any as of yet. I do not want to go on welfare.

You can file for divorce and ask for attorney fees. You may be entitled to spousal support as well as child support. Talk to an attorney to discuss further.

Contact a family law attorney in your community. There are statutes in place in California by which the court can order that your husband advance money for your representation. You will be asked to start seeking employment, however.

In this situation is highly probable that a good attorney would get the court to order your husband to pay your attorney fees. Call the Idaho State Bar and get a referral.

Not an uncommon problem. Most women in your situation borrow a retainer from a relative or charge it to a charge card. There is a legal presumption that you will receive 50% of the marital property so there may be cash assets to repay. When the action is filed at the temporary hearing if there are any accounts, you can ask the court to allow you to withdraw a portion. You also have a right to ask the court to require your husband to contribute to your costs and attorney fees and for support and maintenance during and after the divorce.

Borrow money or use a credit card to file for divorce and for a hearing asking for spousal support and for him to be ordered to pay fees. He's been controlling the money and has a business. This case does not sound like it'll be straightforward as there will be discovery to be done and a business to value and divide. There also sounds like there are minor children so he will have to pay child support. Financial control like this is another form of abuse/domestic violence.
