What should I do if confronted with divorce by my husband?

More details to this question:
I have been married 10 years to my husband, but now he wants to divorce me without any real explanations. He forced me to leave the house, and now I am very depressed. Can you help figure out what my rights are?

In Florida, he cannot force you to leave the marital home, unless he obtains a court order stating that you cannot be there. You need to consult with an attorney in order to best determine your potential rights and options.

If he filed for divorce, the court will grant it. The question is how will assets and liabilities be divided. I suggest you get a lawyer and don't wait. Since you didn't mention children, I assume there are none at issue.

Either spouse is entitled to a divorce if they want one, on any grounds they have, they only have to claim there are irreconcilable difference (they do not need to detail those differences). Your spouse was not entitled to "kick you out" of your home. Both spouses are entitled to remain in their home during a divorce unless and until a court orders otherwise. You are entitled to a fair division of Assets and Debts, if you have children, you may be entitled to Child Support. The lesser earning spouse may be entitled to Spousal Support.

First things first: consult an experienced family law attorney in your area. It's almost always worth the money. That said, assuming you live in Wisconsin (for whose law this corner of the site is dedicated), which is a marital property state, you are presumed to be entitled to one-half of the assets accumulated during the marriage, and one half of the debt. It doesn't matter in which spouse's name the asset is titled. There are, of course, exceptions and details which your lawyer will have the time to discuss with you. If you have children, and they will reside with you for significant amounts of time, you will likely be entitled to child support. The standards are 17% of his gross income for one child, 25% for two, 29% for three..... Again, there are exceptions and details and formulate applying to numerous different situations.

You have many rights with regard to property spousal support and child support. What you might want to do is sit down with an attorney for a consultation in order to figure out all your rights. You might also consider mediation as a way to go if your spouse agrees. Mediation is fast effective and affordable.
