QUESTION

What state should I apply for a military divorce?

Asked on Jan 31st, 2013 on Divorce - Florida
More details to this question:
We did a marriage by proxy in August. I was in Florida and he was stationed in Texas. We moved to NC in October. I want a divorce but I'm not sure of the state to file in. His permanent residence is Ohio and mine is Florida; but his new station is North Carolina. We each still have driver's license and license plates from our home towns. We have no property or assets to split. And no children. I gave up everything to come here to be with him, so we have to live together as I have nowhere to go. Since he is active duty, I'm troubled with the state in which I have to file. Any assistance would be appreciated. Thank you.

You probably must file in NC. That state is where you reside now and have resided. Speak with a local attorney about it.
