QUESTION

When is divorce official?

Asked on Jan 16th, 2013 on Divorce - Michigan
More details to this question:
I had a divorce settlement in court but the papers have not been signed by judge yet. In the papers are certain restrictions on deductions I can take when filing taxes. If the case has only been heard by a judge but the decree has not been signed to I still have to abide by the stipulations of the divorce?

If you made an agreement and it was submitted to the judge you should honor your word. Just because the courts are backed up and can't get things processed as fast as we would like is no reason to go back on your agreement.

The divorce becomes official when signed by the judge. However, if you have reached agreement it would be extremely unwise for you to ignore it simply because the judge has not yet performed the ministerial action of signing.
