When will I or we be called for for our filed divorce?

More details to this question:
I filed for divorce on 8/2/12 so far I keep going online and checking for pending dates but nothing so far. Does anyone know by when I/we will be called? Also we had no assets together like accounts, homes only one car under both our names. Iโ€™m keeping the car the only thing I requested was for him to continue making payments. He hasn't and at this point I just want those divorce papers. I also filed through legal aid because I had lost my job.

Something sounds wrong. If this is all that you have, or don't have, you should have been divorced by now.

You need not wait for the court to schedule a hearing, because it probably will not do anything unless you request it. Ask for a pre-trial conference to determine the issues and schedule a date for trial. Be prepared to make a detailed proposal to the other spouse about property and any other matters which are, or could be, in dispute. I wonder why your Legal Aid lawyer is not telling you this, but s/he should do so.

You need to call the Clerks office and ask them why it hasn't been set yet. Also, if u have an attorney you should consult with them regarding this issue. You may also need to file the paperwork for mediation if a Settlement Agreement has not been signed by both parties and filed with the Court. There are documents and things that must be done before a final hearing is set. You need to find out if you need to do anything.

In California, you need to move your case forward. Once you file, it is expected that you are working toward a settlement, or doing discovery, or have come to a temporary agreement until you either request a trial date (once you have done all necessary steps required before you file papers asking for a trial date) or you file a full Judgment with a Settlement Agreement. It sounds as if you really need an attorney to help guide you through this process. If you have actually agreed upon the terms of your settlement, you just need to make sure all steps are completed and proper forms are filed, which should not be too expensive.

Filing does not get you a court hearing or a court date. If you want him t make the payments you need to file for a hearing. If you want the divorce done, there are a lot of documents that need to be filed apart from the initial paperwork.
