Where should someone file for divorce?

More details to this question:
A couple was in New York State, but moved to New Jersey after 7 months. After a little less than a year they broke up, and one spouse moved to Florida. Where should you file for divorce? The other spouse still lives in NJ?

You should probably wait the additional five months and file for divorce in New Jersey.  You are required to be in New Jersey for 12 months before filing for divorce, but if one person still lives here, and will continue to live here, that's where you should file.
