Which is better for us, annulment or divorce?

More details to this question:
We got married on July 19, 2013. My wife is already talking about annulment or divorce. If we both agree, no children, not living together, what is our option?

Annulments are generally less problematic.

First of all, there are very specific requirements you would have to meet for an "annulment". Merely having a brief marriage does not satisfy the requirements for an "annulment". I have represented couples in the past with marriages that terminated in 30 days or less. Regardless of the length of the marriage, if you do not meet the statutory requirements, your request for an "annulment" will be denied and you will have to proceed with a divorce action.

Unless you can meet the standards of fraud or insanity, you must file for dissolution of marriage not annulment. There is a process called a joint petition for dissolution of marriage which is good for short term marriages with no children or assets. Check that out online or at the court.

Unless there is grounds for annulment, divorce. You have not been married long enough for community property to be an issue.

Most people would prefer an annulment or divorce if for no reason other than the fact that an annulment treats you under the law as if no marriage had ever occurred. Some people like the idea of getting an annulment to avoid the stigma of saying they are divorced. However, you cannot simply choose between an annulment or a divorce. Annulments can only be obtained under certain circumstances.

In Florida annulment is almost impossible.

If it is just irreconcilable differences then its a divorce. If there was fraud, insanity or failure to consummate the marriage you might try annulment. In my experience an annulment is much more difficult to get.
