QUESTION

Can I appeal an OWI that I was found guilty on?

Asked on Jan 19th, 2013 on DUI/DWI - Florida
More details to this question:
I was charged with an OWI when I was never pulled over, no blood alcohol test, no admission to drinking and driving? I was given a ticket when an officer claimed my girlfriend said we drove my car drunk; found guilty in municipal court by a judge.

You can file an appeal on any trial if you file the notice of appeal within 30 days of the sentence date. The chances of your winning the appeal or not good in most cases, especially a DWI bench trial.

You can appeal rulings of the court (for example, denying a motion to suppress or motion for judgment of acquittal) but the jury decision is a finding of fact that is generally difficult to appeal.

When did they conviction occur, there is a very short time period during which you may have a right to appeal. From what you are stating conviction seems like it might be successfully appealed.
