Can I avoid jail on my third DUI?

More details to this question:
I did not take breathalyzer. They took my blood. My previous DUI convictions were in 2003 and 2004.

I doubt it. An OWI third is a felony in Michigan and if you avoid jail on number 2, you were pretty lucky.

All depends on the court and county in which you are charged. Certain have policies that mandate jail others may go along with in-patient treatment instead have your attorney advise you before you plead to anything

You should see an attorney, depending on your jurisdiction it may be that the other 2 infractions, which are significantly into your past, may or may not be used as enhancements. If you are charged with a drinking and driving third it is most probable that you will get some incarceration. See an attorney now!
