QUESTION

Can I ever get my DUI expunged?

Asked on Dec 19th, 2012 on DUI/DWI - Michigan
More details to this question:
I've been having such a hard time finding a job after getting this DUI. I don't know what else to do because I really need to find a job. Feels like I'm being discriminated on because of the DUI. Can I ever get this thing expunged? Do I have to wait 10 years?

I am afraid a DUI will never go off your record. After about 10 years, you may not find it on Michigan Master Driving Record; however, it is always on the Secretary of State's and police lien system. The reason is because if you get 3 DUI's in a lifetime, under Heidi's Law, you can be a felon. It used to be 3 within 10 years. So in order to keep track of someone's DUI/OWI/OUID/Impaired driving convictions, they are always there. You can never get them expunged. Sorry, but people ask me this all the time, and a drunk driving offense sticks around forever.

You cannot. It is specifically excluded by statute. It will never disappear and will always be on your record. Sorry for the bad news.
