Can I get a DUI even though I wasn’t pulled over?

More details to this question:
I woke up early in the morning for work and I got a flat tire that cause me to flip over. I drank the night before. The cop found me walking and he did not pull me over. Can he cite me a DUI?

If you were smart enough not to admit driving then the prosecutor cannot prove that you were operating the vehicle. If there were no witnesses and no admissions you will win the trial, but why do I think you admitted driving the vehicle?

Yes. There is no requirement that there be a pull-over for someone to be charged with a DUI. You should hire a DUI specialist, because you may only have 10 days to save your license if the cop decides to cite you for DUI.

He can if he feels that you were under the influence and your flipping over was the result of you being intoxicated.

It's possible you could be cited for a DUI, depending on what the police officer believes. If you are cited, you should hire a lawyer immediately to help you fight the charge. You have a good defense, and a lawyer will help you.

Were you still under the influence?? Did you admit to the cop that you had been driving?? and there was the flipped over car that had been in an accident. The answer is yes.

You can be charged with DUI only if there is evidence that you were driving a motor vehicle while under the influence of alcohol.
