QUESTION

Can I get a probation extension on my DUI?

Asked on Jun 19th, 2015 on DUI/DWI - Michigan
More details to this question:
I pleaded no contest to a wet reckless in April 2014. I was required to complete an alcohol program by October 2014. I began the alcohol program but did not have enough time to complete it before leaving for graduate school in the United Kingdom. The alcohol education center gave me a 24-month leave of absence from August 2010. I went to court and got an extension on my probation until February 2014. I have been in the UK studying since September 2013, and I need another extension on the probation requirements. Will I have to return and see the judge in person, or can an attorney request and obtain the extension on my behalf?

Since courses have a lot of discretion in these matters, you can't know the outcome until you try. Ask your lawyer to file such a request. Provide him or her with documentation showing these facts as you laid them out in your question. If it works, well and good. If it does not, you'll have a visit home which probably will include some more pleasurable activities apart from a brief court appearance.

An attorney can go to court and do it without you. You should get the extension before a warrant goes out.

I would think an attorney could plead your case for additional time.
