The issue is did you tell the police or any witness that you were driving or can prosecution prove somehow that you were the driver...that is the whole case.? it is not illegal to be a drunk passenger in a car. If the prosecution can't prove you were driving then you should have a good chance of success at trial.
An OWI charge, like any other, has to be proven to the Court beyond a reasonable doubt. The Constitution guarantees you the right to remain silent and not have that silence used against you. If your friend will say he was driving, you are in great shape. If he says you were driving, you are in trouble. There may also be other witnesses as to who was driving. In short, I would say "no." You should not expect your case to be dismissed, That is an unreasonable expectation. At best, you should hope to win at a trial.
