Does an out of state DWI count?

More details to this question:
I got a DWI in 2011 when I was much younger. I just got another one. Is this considered a first DWI still or what happens?

In California all DUI's in the last 10 years count - no matter where they are. Sometimes, and I mean like about 50% of the time the DA will not find your out of state DUI - so you could get lucky. Your DUI is a second DUI in Californnia - (We call them DUI Driving under the influence here, not DWI) . >

Yes, out-of-state DUIs count. All states share information about DUIs so this latest DUI will be considered your 2nd DUI.

Depends on what they charge, if the states reciprocate it should be a second.

Yes if the prosecutor finds out about it. Certain states are better connected with California, so there is a higher chance the prosecutor will see it when your record is run. A second DUI is more serious, as you can see from this chart:

It depends. Most states other than California have broader DUI statutes so a DUI in another state may not count as a prior. This is information No One is going to give to you. You have to find the attorney who knows how to press this issue.
