You should consult a DUI attorney, these facts create a very strong defense to the charges you face. If you were driving an hour before your were stopped and investigated for DUI the DA will have difficulty proving that you were driving at the time of the description and if you were driving they still have to prove that you were .08 or above. A skilled DUI lawyer can use these facts to help you.

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. Since we do not have all the facts, it is impossible to give a completely accurate answer. Do you have an alibi as to where you were when this event occurred? Had you been drinking? If so, how much and for how long> What was your BAC level?

You need to hire a DUI specialist. You've got a largely circumstantial case, and you need someone who knows this stuff to represent you.

Sounds like you have some potential defenses for trial. You should not post anything else about you case on the internet and should contact a lawyer.

DWIO charges are serious. Without seeing the police reports or the results of your blood test, I cannot say. My advice to you hire an attorney.

Something that would be pretty hard case to prove especially if you had a good alibi.

1. Normally, for first offense DWI, the police have to see you operating the vehicle. 2. If you can account for your whereabouts at the time you were allegedly seen, it will help. 3. Plead not guilty and demand a court-appointed lawyer then discuss the matter with him.

You need to hire a DUI attorney in your area. Start by calling about 3 to 5 different attorneys. You should be able to get a feel for the different attorneys that are out there. Hire the best attorney that you can afford and you are comfortable with. Don't necessarily allow price to dictate - for a DUI case there can be several different complex issues. An attorney that charges to little may only want to resolve your case after one appearance.

They have to prove that it was you that was driving before being able to convict you. Not just that your car was involved.
