How much am I facing for a second DUI?

More details to this question:
I have two driving while intoxicated I have a driving on suspended while under the two years suspended and one driving on suspended while not but my license are still suspended how much time do I face.

In Michigan you can get up to a year in jail for the second DUI. Get a lawyer.

Is South Carolina the jail time for a second DUI will depend upon the BAC of the second DUI conviction If it is less that .1, the minimum is 5 days and the maximum is 1 year If it is between .1 and .16, the minimum is 30 days and the max is 2 years If it is over .16 the minimum is 90 days and the maximum is 3 years.

Your question is a little unclear. You have one prior DUI conviction, and one pending DUI? Or do you have two DUI convictions and one pending DUI? Also, do you have a prior driving on a suspended license (14601.2), and another VC 14601.2 driving on a suspended license pending (along with the new DUI charge)? The answers to those questions will effect what the potential penalties would be for your case. I can safely say this though....you need an Attorney to handle this for you.

If you already have two DWAI's this could be a third offense. In Colorado, a third DUI carries a minimum of 60 days in county jail and likely 180 plus, depending on how old the priors are. In Colorado multiple DUI's are always misdemeanors - but there is a Habitual Traffic Offender charge that you could fall into and this is a felony. From your description, it is unclear if Colorado's HTO laws would impact you or if this is a second offense. As you have charges that impact your ability to drive and carry significant jail time, I would retain a local DUI attorney in your area to defend and represent you in all cases.

If this is just your second & no aggravating circumstances (wreck hurting others; child under 13 in car), then you are facing up to 1 year in jail and up to a $4,000 fine.

The maximum time in jail for a second dui conviction is one year. The maximum time in jail for each suspended license charge is 6 months. However, it's doubtful you will get the full 2 years or even close to it. Depending on the county you are in, you are looking at some time in jail because the state has set a mandatory minimum time of jail on the second time dui and the driving on license that is suspended because of a DUI conviction. But you might be able to work it out where you can be placed under House Arrest rather than going behind bars.

A second time DUI has a potential jail sentence of 90 days to 1 year. Additional time may be added for the driving with a suspended license.
