The California Vehicle Code, section 23546 requires a minimum of 120 days in county jail and permits up to a maximum of one year in jail for a third DUI (provided the two prior DUI's were within 10 years of the current offense).

That is a felony in Michigan and you are facing prison time. You may be eligible for Sobriety Court which is your best option of avoiding prison and keeping a felony DUI off your record.

You need to contact a DUI attorney, a third offense carries a statutory MINIMUM of 120 days, many counties do not offer alternatives to jail and many do not sentence to "just" the minimum.

That is very difficult to say without knowing in what county the case is and who your judge will be. Every judge has his/her own policies for sentencing on OWI 3rd cases. Where is your case?

A minimum of 120 days in jail, not including any probation violations you may have. Time to hire a DUI specialist.

In California there is a 120 day mandatory minimum jail sentence for a third time dui with a maximum sentence of one year.
