How much jail time for DUI manslaughter?

My sister is in a lot of trouble because she accidentally killed a woman when she was driving. She was legally drunk and there's a breathalyzer that proves it. I am so sick over this and so sad she killed her. I feel awful for her family. And I don't know what to do to help my sister who is in jail right now. She doesn't have a good lawyer either. Just a court appointed one. What should she do? She's 24 and has her whole life ahead of her. She feels awful about this too. They had to put her on suicide watch. How many years is she going to get? Range?

In Michigan the charge for this would carry up to 15 years in prison.

Even if she has no priors, she is looking at prison time. This is a very serious offense and should not be taken lightly. She needs to have experienced criminal representation, ideally someone who has handles lots of DUI cases or vehicular homicide cases or both.

You, and your family, should discuss this with a DUI attorney, simply because a breath test comes back above the legal limit doesn't mean that your sister is going to be found guilty. The charges she faces may be filed as either a misdemeanor or a felony, if it is a felony she faces up to 6 years in prison, if it is filed as a misdemeanor she is looking at county jail up to one year. The facts of the case will determine the likelihood of whether the case is charged as a misdemeanor or felony, again you, and your family, should contact a lawyer to help you through this difficult time.

Totally depends. A good lawyer may be able to procure some sort of reduced sentence. The facts associated with this tragic event will be important in assessing the type and length of time that your sister receives in terms of sentencing.
