QUESTION

How will I know if I got arrested and charged for a DUI?

Asked on Mar 20th, 2013 on DUI/DWI - California
More details to this question:
I got pulled over for a traffic violation for failing to turn off high beams. They made me do all the field tests for DUI including blowing. I'm not sure what I blew. All I know is they handcuffed me and took me to the hospital for a blood test. They had someone come pick me up and I still have not heard anything about that night.

They may have sent the blood to a crime lab and are waiting on the results. This can take several months.

You haven't been charged. The DA does that. Seems like you were above .08. You were arrested for it (what else?)

You will know because they gave you a notice to appear and took your license, if neither of these things happened you need to contact either the prosecutor's office in your jurisdiction, or the law enforcement agency that arrested you to determine what happened that evening and whether you are facing criminal charges.

It can take several months to get the blood test back. Depending on the county, you will receive notice to appear in court or they will simply issue a warrant for your arrest. You might contact a local bondsman to be on the lookout for a warrant.

Usually, you are issued a citation. It is unusual for an officer not to issue a citation but it could happen. I would call the arresting agency and ask about the citation. Because it is a DUI you have certain rights that expire as time elapses. For instance, you have 10 days to request a driver license hearing and, if you do not, your license will automatically be suspended. Hope this helps.

If true, those facts are very weird. They should have at least left you a citation or citations with you. You were definitely arrested, if you were taken to the hospital and blood was drawn.

You absolutely were arrested for DUI. You need to hire a DUI specialist ASAP, because you have only 10 days to save your license.

You would most likely learn if they are charging you by the court or a law enforcement officer contacting you with a summons to appear. Since you might have been inebriated at the time, double-check your pockets and your car to be sure there is no citation that you might have ignored. You can call the Clerk of Court, or better, the prosecutor's office to see if they have issued a charge against you. If the traffic stop was very recent say within the past five days or so they may be waiting for the results of the blood test.

Get an attorney as soon as possible . Did they take your license? You only have 10 days to contact DMV and request hearing.
