QUESTION

If I violated first offenders program before court date, what do I do?

Asked on Jan 21st, 2013 on DUI/DWI - Georgia
More details to this question:
I was caught smoking pot in my car and was put in the first offenders program. Then a month later before my court date, I was caught doing the same thing. I was told that if I am charged with two misdemeanors. I can't go to law school, go in the military, and a bunch of other things. I need help ASAP. I need a way out of this before it potentially ruins my life. I need loopholes and a crooked mind to get me out of this.

I have no idea what you mean by a "crooked mind." Do you mean that you need a lawyer, because that seems obvious as you are not going to be able to handle the case yourself and I would hope that you are aware that if you are indigent a lawyer will be appointed to represent you. You can be a lawyer with a misdemeanor but not a felony and the military can give you a waiver if it is a misdemeanor. Retain a good criminal lawyer to handle the case and try to get an ACD dismissal.

You should speak to an attorney with experience handling these types of cases in your county. If your use of marijuana is prescribed by a physician you may have a defense to the charges you face in court. Regarding the DUI program kicking you out, you need to contact them about the steps necessary to be readmitted, unless you are attending the DUI classes due to a court order in which case you will need to return to court for a new court order before they will accept you back into the program.

You need to hire a lawyer to negotiate with the Judge so that the charges are ultimately dismissed.
