QUESTION

Is it possible to terminate my DUI probation?

Asked on Jun 19th, 2015 on DUI/DWI - California
More details to this question:
I was wondering if it was possible to remove my DUI probation? I am trying to enlist in the United States Army. But the Army requires a clean record with no probation, they also require that if possibly lifted the reason for a probation lifted cannot have association with the US Army.

You need to hire a lawyer to file a petition for early termination.

Some of your letter is not quite intelligible. But if the real question is whether you can be discharged from probation early, the answer is that it is possible, and the best person to ask the court to do so is your Probation Officer. You already know, I am sure, how important it is to stay on the good side of your PO. Make it even stronger, and ask him or her to do what needs to be done for an early discharge. I suppose you could file such a motion on your own behalf, but you would have to have unusually strong reasons for an early discharge and I am not sure entry into the armed forces is such a one. Your best bet is to consult the lawyer you had in the underlying case. If you did not have a lawyer, locate and consult with a skilled criminal defense lawyer to see what he or she can accomplish.

Yes you or a lawyer can file a motion to terminate probation for good cause - joining the army. You can then get the case expunged - not the same as dismissed.
